Terms & Conditions

Please read the following carefully. By submitting an order on this website, you are agreeing to our terms, which will apply to any purchase made directly on this website. If you do not accept our Terms & Conditions, we are unable to supply you.

1. Information about us

 

1.1 This website  www.kathryncuthbertson.com is operated by Kathryn Cuthbertson MVO (hereinafter also referred to as “us”, “we”, or “our”). All purchases made on this website are governed by the following Terms & Conditions. Specialist bespoke requirements may deem additional clauses 

 

2. Your status

 

2.1 By placing an order through our website, you warrant that you are at least 18 years old and legally capable of entering in to binding contracts. 

 

3. Purchase Contract 

How the contract is formed between you (the consumer) and us (the supplier)

 

3.1 After placing an order through our online shop you will receive an e-mail from us acknowledging our receipt of your order, this does not mean that your order has been accepted. We reserve the right to decline your order for any reason, including but not limited to shortages or unavailability of stock and inability to authorise payment. The contract between us will only be formed when we send, and you receive a dispatch confirmation e-mail.

 

3.2 All goods are sold subject to the condition that they will not be resold or otherwise circulated without prior consent.

 

4. Methods of Payment 

 

4.1 Payment may be made securely through Wix Payments using all major debit and credit cards, including Visa, Mastercard, Discover, AMEX, Diners, CUP, JCB and Maestro. You cannot pay for an online order by cash or cheque. 

 

4.2 Authority for payment will be requested from your card issuer at the time of your order, you will only be charged once the goods are dispatched. 

 

4.3 Bespoke and Corporate orders will receive an invoice which is payable within one month of issue.

 

5. Price and Delivery Charges 

 

5.1 All prices stated on the website are in pounds sterling (GBP £) and will be inclusive of any VAT payable

 

5.2 The price of the goods will be as quoted on the website at the time you confirm your order (usually by clicking the ‘checkout’ button)

 

5.3 Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a dispatch confirmation.

 

5.3 The price of the goods does not include a charge for delivery. These charges are in addition and will be calculated automatically and visible when you place your order. All orders are dispatched using Royal Mail First Class delivery (2-3 working days) We only ship within the UK.

 

6. Availability and Delivery 

 

6.1 All chocolates are handmade to order in small batches and are not usually available for next day delivery. Production from receipt of order takes up to three working days to complete before date of dispatch.

 

6.2 All delivery timescales are given in working days. We will not dispatch orders after Thursday afternoon to avoid perishable products being held by Royal Mail over the weekend. We will also amend delivery dates should the UK suffer an extreme heatwave.

 

6.3 Your order will be fulfilled by the delivery date set out in the dispatch confirmation, unless there are exceptional circumstances.

 

6.4 Delivery will be made to the address specified by you when you place your order. It is however your responsibility to provide us with accurate delivery address details. We will not check or verify addresses supplied by you. We shall have no liability to you whatsoever, financial, administrative or otherwise if your order fails to arrive due to you providing incorrect delivery details. 

 

6.5 We will always try to supply you with your entire order. In the event that your order is delivered incomplete, you must notify us promptly via the contact page ‘Get in Touch’. Please send photographs where possible of the packaging and contents of your entire order.

Our liability will be limited to the price of the goods not delivered or incorrectly delivered as well as the cost of delivery.

 

6.6 We guarantee the high quality of our chocolates, but should you promptly notify us of your dissatisfaction we will fully refund the cost of any products should they fit one of the following criteria 

  • The products are damaged

  • The delivery quantity is incorrect

  • The products are incorrect

  • The products failed to arrive (as long as the correct delivery address was submitted at time of order per clause 6.4)

 

7. Cancellation Rights 

 

7. Orders that are already in production are unable to be cancelled due to the nature of our small bespoke business. 

8. Ingredients used in our products 

 

8.1 All our products are made in an environment where known allergens are used. All products contain or may contain trace amounts of nuts, eggs, cereals containing gluten, lupin, milk, soya, sulphur dioxide & sesame.

 

8.2 No additives, preservatives or artificial flavourings are used in our chocolates. We recommend consuming within the use-by dates attached to all packaging and storing in a cool, dry place away from direct sunlight.

 

8.3 It is the responsibility of the consumer to ensure that they read the entire ingredients list for all items ordered, known allergens will always be listed in bold.

 

9. Warranty and Liability

 

9.1 Nothing included in these Terms and Conditions will restrict our liability for death or personal injury arising from our negligence nor our liability for fraudulent misrepresentations to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

 

9.2 We will not be deemed to be in breach of contract of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any circumstances beyond our reasonable control including, but not limited to, flood, fire, strikes, riot, accident, pandemics or acts of terrorism.

 

10. General 

 

10.1 These Terms & Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.

 

10.2 Kathryn Cuthbertson MVO reserves the right to change or amend any details contained in these Terms and Conditions at any time without notice. 

 

10.3 All products, prices, ingredients & availability are subject to change without notice at the discretion of Kathryn Cuthbertson MVO.
